Terms of Use and Service Agreement

This document is a legal agreement between the online store fabrika-ukrainskie-konstrukcii.com.ua (hereinafter referred to as the "Seller") and a person placing an order through the Website (hereinafter referred to as the "Client"). This agreement is governed by the laws of Ukraine, including but not limited to:

• The Law of Ukraine "On Electronic Commerce";

• The Law of Ukraine "On Consumer Rights Protection";

• The Law of Ukraine "On Advertising";

• The Law of Ukraine "On Personal Data Protection";

• The Law of Ukraine "On the Principles of State Language Policy".

1. Registration, Collection of Personal Data, and Confidentiality

1.1. By placing an order on the website fabrika-ukrainskie-konstrukcii.com.ua (hereinafter referred to as the "Website"), the Client agrees to this Agreement and the Privacy Policy.

1.2. The Seller collects, stores, and processes the Client’s personal data (full name, phone number, email, postal address) to provide services and fulfill orders.

1.3. The Client consents to the processing and storage of their personal data in the Seller's database and the transfer of this data to third parties (e.g., delivery services, payment systems), if necessary for order fulfillment.

1.4. The Seller will not disclose personal data without legal grounds, except as required by law.

1.5. The Client has the right to access, correct, or request the cessation of processing of their personal data.

1.6. Personal data may be used by the Seller for marketing purposes (sales analysis, newsletters, service improvement).

2. Order Placement

2.1. Orders can be placed via the cart on the Website, by phone, through messengers, or via email.

2.2. After placing an order, the Client receives an email confirmation and a follow-up call from the manager to clarify the details.

2.3. An order is considered accepted only after it is confirmed by the Client via phone or in writing.

2.4. A confirmed order constitutes a concluded sales agreement unless otherwise specified in a separate contract.

3. Delivery and Payment

3.1. Delivery within Ukraine is carried out by courier services: Nova Poshta, Delivery, SAT, Ukrposhta.

3.2. Delivery time is from 1 to 5 business days depending on the region and product type.

3.3. Delivery costs are determined by the carrier. Approximate rates:

• Textiles: 40–80 UAH

• Garden furniture, swings: 600–1600 UAH

3.4. The Client has the right to cancel the order before it is handed over to the delivery service or reschedule delivery.

3.5. The Seller is not responsible for delays caused by delivery services but will assist in resolving such issues.

3.6. Payment methods:

• Cash on delivery (COD)

• Online prepayment (bank transfer or card payment)

4. Returns and Exchanges

5. Dispute Resolution

5.1. All disputes shall be resolved through negotiations.

5.2. If no agreement is reached, the dispute shall be resolved in accordance with the laws of Ukraine.
